Terms and Conditions

  1. That the sales Associate agree and accepts the said engagement on non exclusive basis only.
  2. The sales Associate shall notify the Company the details of their prospective buyers by mail/letter in the format provided by Company before taking for site visit. (a) if the buyers or his/her spouse or their legal heirs are found to be approached the Company directly ./ of through other agent, then that buyer will be dealt directly by Company. (b) If the buyer is not satisfied with the service of Sales Associate and approaches us directly, the Sales Associate wills not deal the buyer. In both the cases the Sales Associate will not be eligible for commission. Otherwise, the leads provided by Sales Associate will have first right to close booking for 90 days from the date of login of the lead of their prospective buyers with the Company.
  3. That the Sales Associate shall, however, be provided with the details of the real estate units available, pricing, mode of payment and other relevant terms at that point of time in the form of write-up or brochures printed and published by the Company. No units will be blocked and bookings will be taken on first come first basis only.
  4. That the sales Associate shall make the marketing of the real estate units strictly in conformity with the rate, terms and other information provided by the Company. That the Sales Associate assures/conforms/shall not make any of the other then the brochures/write-ups or by other means without getting the written confirmation from the company.
  5. That the Sales Associate further agrees accepts and undertakes that the responsibilities and obligations shall continue until the said transaction of the Allottee/purchaser, till the collection of 30% of value of the unit and execution of agreement of sale. The Company accepts that the responsibilities and the obligation of the Sales Associate hall be automatically stand seized after payment of 30% of value of the unit and execution of agreement of sale by/purchaser.
  6. That in consideration of Sales Associate providing these services from time to time in terms of this Agreement, the Company shall pay to the Sales Associate 1% of basic unit cost as per the commission / referral fee.
  7. In the event the allotment in favour of the purchaser is made by the company is cancelled/terminated
  8. For any reason whatsoever, before the company receives 30% of the total cost of the real estate unit from the prospective purchaser/Allottee the Sales Associate would not be entitled to claim any commission /referral fee. However, if the prospective purchaser/Allottee has accepted the Provisional Allotment letter of the Company and has received the 30% of the total cost of the real estate unit, the Sales Associate is entitled to full commission / referral fee due on the unit.
  9. The Sales Associate shall sell the unit price as fixed by the Company only and no discount should be passed on by the Sales Associate to the purchaser.
  10. The Company shall have the exclusive rights to reject the request for allotment made for any person brought by the Sales Associate, irrespective that such person is willing to accept all the terms of the Company. If the Company declined booking/allotment for any such Party, the Sales Associate would not be entitled for any commission /referral fee.
  11. The Company shall remit the commission/referral fee payable to the Sales Associate, within 30 days of the Company receiving the bill/invoice corresponding to the payment received by the company from allotee / prospective purchaser. One bill will be raised on the last working day of the month for the bookings made and 30% payments realized from the purchaser by the Company.
  12. That the Sales Associate agrees to keep all the information that has come to his notice / knowledge in respect of any matter relating to the real estate unit, including its pricing / costing, details of parties to whom the Company might have sold the real estate units and / or the rates at which Company might have sold such units strictly confidential. In any event, the Sales Associate commits breach of this obligation, then the Company is entitled to claim and recover from the Sales Associate all the losses and damages that the Company might have suffered due to such breach of this obligation by the Sales Associate.
  13. This Agreement is valid only for the period of six months and all payments / referrals are subject to the validity of this agreement. This Agreement shall be extended on mutual terms and conditions in written only.
